I believe it would be considered copyright infringement, yes.

My interpretation is that you didn't pay any licensing fees to copy any tracks to your iPod or computer. I don't think the library fees are covering that.

I'm not a copyright attorney, so it would be best to ask somebody who knows these laws very well.

Usually if a musician (band) plays music that was written by someone else and the musician (band) makes a profit from that (directly or indirectly), the musician (band) should pay royalties to the original author of the music. Normally no one can just make money from other people's music. An intellectual property lawyer will be able to give you professional advice on this issue.

If someone plays anothers music that is copywritten, and makes a profit on that material, on a regular basis, is that person infringing on that copyright and what can be done to stop it?

Thanks Sandro for posting this!

It is important to take a close look at such cases. Often these "artists" use graphic elements of other peoples' images and create new ones which is in violation of the submitter terms at many agencies.

You have indeed a strong case if you find such elements that were stolen from your images. It is not permitted by copyright law to take (parts) of someone's artwork and use them again SOLELY for the purpose of resale!

However if the "artist" in question "just" uses your and other artist's ideas to create new images from scratch, meaning that she draws every element of the image herself then there is very little you can do. In such case you will need the help of a lawyer.

As long as you can prove that elements from your images have been used in her compositions you can write to the agency where she sells affected images. Usually the agency will remove her portfolio after thorough investigation.

If you have strong evidence to back all this up write to all agencies where she is submitting her work to let the agency decide if she is within bounds or not.

I wish you good luck! Don't hesitate to contact me directly if you need more help.

This is really very annoying. A member of Fotolia (Vanessa) copied in the past, pictures of Sarah Kay, a very famous artist. The only thing fotolia has done is to delete these images.

Now the same person copied images from other members and other Stock sites, in the same way as you specified it.
--> she re-create the image themselves add their own personal touch and upload them as their own.
This person has no own ideas, she is only able to design the form.

She has hundreds of bestseller-copys in their portfolio.
These images are sold always cheaper as the original. This is her dirty trick. She makes a lot of money with this barefaced strategy.

You can see the portfolio of Vanessa here
http://com.fotolia.com/p/200817381

How can people protect themselves against such person? Fotolia do nothing.
It seems the only way is to contact my lawyer.

If you want to sell your 3d or vector art, try clipartof.
They are looking for artists.
A great site offering 50%.
If you can except Paypal check them out.
